As a Banking and Payment Services Intermediary, our firm :

  • is governed by the articles L519-1 to L519-6 from Monetary and Financial Code and subsequent related decrees and orders ;
  • complies with the provisions of the Monetary and Financial Code, as amended by the decree no. 2012-101on the status of IOBSPs, particularly with regard to all the information to be provided to the Customer;
  • is supervised by the Autorité de Contrôle Prudentiel et de Résolution (ACPR), whose address is 4 place de Budapest - 75036 PARIS CEDEX 09 - site : www.acpr.banque-france.fr, tel : 01.49.95.40.00 ;
  • certifies that he/she is not subject to any contractual obligation to work with one or more credit institutions, and declares that he/she does not hold any voting rights or capital in a credit institution;
  • declares that no credit or payment institution holds more than 10 % of its capital or voting rights;
  • declares that it does not hold more than 10 % of the capital or voting rights of a credit or payment institution;
  • declares that, during the previous year, more than one third of its turnover with a credit institution was generated by intermediation ;
  • provides a list of the credit or payment institutions with which it works, as well as the terms and conditions of its remuneration.

Brokerage and intermediation in banking transactions

Mortgage brokerage, a specific credit intermediation service, consists of "presenting, proposing or assisting in the conclusion of banking transactions or payment services or carrying out any preparatory work or advice in connection therewith" (art. L. 519-1, I and R. 519-1 of the French Monetary and Financial Code). Brokerage therefore involves bringing two parties together with a view to concluding a contract.

  • Home loan contracts : Credit transaction to finance the construction or acquisition of a home or land, or renovation work over a threshold of €75,000.
  • Consumer credit contracts : Credit transaction for an amount of less than €75,000 for the financing of non-property goods or services for non-professional use
  • Life mortgages : Consumer credit transaction that uses the value of a property asset as access to credit
  • Credit consolidation : The operation of combining several existing loans with different terms and interest rates into a single loan.
  • Other activities : Any banking transactions or payment services other than those mentioned above. Such as the distribution of savings books

Remuneration

In accordance with article L. 519-6 of the Monetary and Financial CodeAny natural or legal person who assists, in any capacity whatsoever and in any manner whatsoever, directly or indirectly, in obtaining or granting a loan of money, is prohibited from receiving a sum representing a provision, commission, research costs, procedures, preparation of the file or mediation of any kind, prior to the actual payment of the funds loaned.
It is also forbidden, before the funds and the copy of the deed are handed over, to present bills of exchange to the borrower for acceptance, or to have the borrower subscribe promissory notes, in order to recover the brokerage fees or commissions mentioned in the previous paragraph.

The intermediary may also receive remuneration from the lending institution, under certain conditions, without this having any influence on the quality of its proposals. The amount of the fee depends on the nature of the loan and the volume and quality of production. The commission paid by the credit institution covers the intermediary's distribution costs. In this respect, the firm receives a commissioning This commission is calculated as a percentage of the amount of credit granted and is subject to a ceiling. Each partner determines the percentage and ceiling of this commission depending on whether or not the customer is already a customer of the bank:

  • BNP Paribas Grand Est : 0,4 %
  • BP Alsace Lorraine Champagne no remuneration for the bank
  • CA Alsace Vosges from 0.2 % to 0.4 %
  • CE Grand Est Europe : 0,25 % (particuliers) et 0,5% (professionnels)
  • LCL Est no remuneration for the bank
  • Interfimo (professions libérales) : 0,25 %
  • SG from 0 % to 1 %

The firm also receives brokerage fees the amount of which depends on the table below:

No payment of any kind may be required from an individual before one or more loans have been obtained.

Insurance brokerage and intermediation

The advisor may offer the Customer Level 1 advice (compulsory), which consists of submitting a contract that is consistent with the Customer's needs and requirements. In this context, the Firm is not subject to a contractual obligation to work exclusively with one or more insurance companies.

The advisor may also suggest the following optional advisory services to the Customer:

  • A Level 2 consultancy service To make a personalised recommendation, explaining to the Customer why one or more of several contracts best meet their requirements and needs.
  • Level 3 consultancy services To issue a recommendation based on an impartial and personalised analysis of a sufficient number of contracts on the market.

Remuneration and transparency

Protection of personal data

The personal data about the Customer, collected for the purposes for which the is linked to the performance of the Missionare processed electronically for the following purposes fulfil the obligations arising from the Contract. The direct recipient of this data is the Contractor, who is required in particular to respond sincerely to requests from the credit institutions contacted.

This data is the subject of the external communication by the Contractor alonefor the sole purpose of fulfilling this contract or legal and regulatory requirements (art. L. 561-1 et seq. of the Monetary and Financial Code, in particular), in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation (GDPR)).

Customers who can prove their identity have a permanent right to access, rectify and delete their personal data (art. 39, Law no. 78-17 of 6 January 1978, as amended). In accordance with the provisions governing the storage of personal data and in view of the nature of banking operations, such personal data are kept for ten (10) years from the date of signature of the contract (Articles L. 213-1 and R. 213-2 of the Consumer Code).

Customers may, for legitimate reasons, object to the processing of data concerning them.

By expressing its agreement to the Contract, the Customer authorises the Authorised Agent to collect, use and store the personal data transmitted by it, and to communicate to any credit institution all information and personal data concerning it, even those covered by professional banking secrecy, in accordance with the provisions of article L. 511-33 of the French Monetary and Financial Code and within the framework of the performance of the Contract.
This data is collected for the following purposes: drawing up one or more finance plans, seeking finance from banking partners, monitoring and managing the file, proposing loan insurance, etc.information relating to our brokerage activity (interest rate information, quarterly newsletter, assessment of the borrower, asset and financial situation).

Information on handling complaints, disputes and jurisdiction

Unless the complaint is particularly difficult, the Contractor undertakes to reply to the Customer :

  • Within ten working days of receipt of the complaint, to acknowledge receipt, unless the response itself is provided to the Customer within this period;
  • Within two months of the date on which the complaint is received and the date on which the response is sent to the Customer.

In the event of a dispute between the professional and the consumer, they will endeavour to find an amicable solution.
A défaut d’accord amiable, conformément aux articles L.616-1 et R.616-1 du code de la consommation, nous proposons un dispositif de médiation de la consommation. L’entité de médiation retenue est : CNPM – MEDIATION DE LA CONSOMMATION. En cas de litige, vous pouvez déposer votre réclamation sur son site : https://cnpm-mediation-consommation.eu ou par voie postale en écrivant à CNPM – MEDIATION – CONSOMMATION – 27 avenue de la libération – 42400 Saint-Chamond.

This mandate is subject to the droit français.

In the event of a dispute arising from the interpretation or performance of this mandate, the parties shall endeavour to settle the dispute by mutual agreement. settle out of court before taking any legal action.

Mode de communication

Le Client et son conseiller pourront utiliser une large palette de moyens de communication :

  • De manière verbale, à l’occasion des différentes rencontres, soit au domicile du Client, soit dans nos locaux, éventuellement, soit sur le lieu de travail du Client s’il en fait la demande. Même si nous souhaitons privilégier au maximum les rendez-vous physiques, des rendez-vous en visio peuvent également être organisés à la demande du Client ;
  • Par entretiens téléphoniques au 03.90.225.279 ou tous les moyens de communication numériques à disposition : courriels, SMS, WhatsApp ou messagerie de l’espace emprunteur ;
  • Par courriers postaux à l’adresse du cabinet, au 8 avenue de la Marseillaise, 67000 STRASBOURG.

Si le Client a émis des préférences quant aux modes de communication et aux créneaux (jours et horaires) à privilégier, elles seront reprises dans le tableau récapitulatif à la fin du document validé.

Le Conseiller fera parvenir au Client toute mise à jour de ces différentes informations, en les lui communiquant par email. Elles seront également consultables directement en ligne. Le Client peut également obtenir à tout moment ces informations sur simple demande auprès du conseiller.
